§ 1 Scope and Definitions of the Terms and Conditions

(1) Coinfinity GmbH, Griesgasse 10, 8020 Graz, Austria (hereinafter: “we” or “Coinfinity”) operates an online store for goods at the website https://www.bitcoin.wien/. The following Terms and Conditions apply to all contracts for the purchase of goods between us and our customers (hereinafter: “Customer” or “you”) in the version effective at the time of the order, unless otherwise explicitly agreed.

(2) “Consumers” within the meaning of these Terms and Conditions are natural persons (and, where applicable, legal entities) and partnerships with legal capacity for whom the conclusion of a contract with Coinfinity is not part of the operation of any business or their business. The purpose of the order is therefore not for commercial, self-employed, or freelance activities.

(3) “Businesses,” on the other hand, are natural or legal persons, as well as partnerships with legal capacity, for whom the transaction in question is conducted in the course of business. The distinction between consumers and businesses is based on the Consumer Protection Act and the Commercial Code. An enterprise is any organization engaged in independent economic activity on a permanent basis, even if it is not profit-oriented. Formal businesses and legal entities under public law, with regard to the provisions applicable to the specific business transactions, are always considered businesses.

(4) “Goods” or “Products” as used in these Terms and Conditions refer to all physical products offered by Coinfinity via its online store; in particular, hardware and accessories related to cryptocurrencies or their storage (e.g., Coinfinity Card Wallet), as well as other physical items, merchandise, books, etc.

(5) The customer shall review these Terms and Conditions prior to the signing of this contract, and both parties explicitly agree that these Terms and conditions constitute part of the contract. The customer may save or print these Terms and Conditions at any time. 

§ 2 Conclusion of Contracts, Storage of the Contract Text

(1) The following regulations regarding the conclusion of contracts apply to orders placed through our online store at https://www.bitcoin.wien/.

(2) Our product descriptions on the Internet are non-binding and do not constitute a binding offer to conclude a contract.

(3) Upon receipt of an order in our online shop, the following provisions apply: The customer submits a binding offer to purchase by successfully completing the ordering process provided in our online shop. The order is placed in the following steps:

  1. Selection of the desired goods

  2. Adding the products by clicking the corresponding button (e.g., “Add to Cart,” or similar)

  3. Reviewing the details in the shopping cart

  4. Accessing the order summary by clicking the corresponding button (e.g., “Proceed to Checkout” or similar)

  5. Entering/checking the address and contact information, selecting the payment method, confirming the Terms and Conditions and Cancellation Policy,

  6. Completing the order by clicking the “Purchase Now” button. This constitutes your binding order.

  7. The contract is concluded as soon as the customer has received a confirmation email regarding the order.

(4) If a contract is concluded, it is concluded with Coinfinity GmbH, Griesgasse 10, 8020 Graz, Austria.

(5) Before placing an order, the contract details may be printed using the browser’s print function or saved electronically. The order will be processed and all information required in relation to the conclusion of the contract, particularly the order details, the Terms and Conditions, and the Cancellation Policy, will be provided to you by email after you place your order, partly by automated means. We will store the contract text after the contract has been concluded, as transmitted to you by email. For security reasons, the contract text is no longer accessible via the Internet.

(6) Input errors can be corrected using standard keyboard, mouse, and browser functions (e.g., the browser’s “Back” button). They can also be corrected by canceling the order process prematurely, closing the browser window, and repeating the process.

(7) The processing of the order and the transmission of all information required in relation to the conclusion of the contract are carried out via email, partly by automated means. You must therefore ensure that the email address you have provided to us is correct, that the reception of E-Mails is technically ensured, and, in particular, that it is not blocked by spam filters.

§ 3 Scope of the Contract and Essential Characteristics of the Goods

(1) The scope of this contract is the sale of goods through our online store. The specific goods offered are set forth in the respective product descriptions in the online store.

(2) The essential characteristics of the goods are set forth in the respective product description. In addition, the following provisions apply to certain product categories.

(3) Products related to cryptocurrencies: A portion of the product range is related to the use, storage, or understanding of cryptocurrencies. These products do not constitute financial services and do not involve the purchase of cryptocurrencies.

(4) Coinfinity Card Wallet

  1. The Coinfinity Card Wallet is a credit card-sized product that displays a receiving address on the front. The corresponding private key is located on the back, covered by a security seal. At the time of purchase, there are no digital assets on the Card Wallet; these can be purchased separately through an exchange or a broker such as Coinfinity (https://coinfinity.co/en).

  2. Coinfinity does not know the private key. The private key exists solely on this Card Wallet; there is no copy of the private key, neither in printed nor in digital form. The Card Wallet must therefore be stored by the buyer with the utmost care.

  3. Once the security seal on the Coinfinity Card Wallet has been removed, the private key, which grants access to the respective cryptocurrency, is visible to anyone who looks at the card. Coinfinity assumes no liability for damages caused by removing the security seal. For secure storage, a replacement security seal is included with every Coinfinity Card Wallet. It is recommended that the security seal be removed only when the respective cryptocurrency is to be sold.

  4. The Card Wallet should be treated like a physical wallet, as losing it will result in the loss of the digital assets stored on it. It is therefore the buyer’s sole responsibility to protect the Card Wallet against loss, theft, or destruction. Coinfinity recommends storing it in a safe or locker. The buyer can import the digital assets held on their Card Wallet into a digital wallet at any time by scanning the private key and then sell these digital assets via any exchange.

  5. The Card Wallet is currently available for two cryptocurrencies: Bitcoin and Ethereum. The currencies are not compatible with each other; therefore, only Bitcoin can be stored on a Bitcoin Card Wallet. In addition to storing Ethereum, the Ethereum Card Wallet also allows for the storage of so-called ERC-20 tokens.


5) Other products: For all other goods, exclusively the respective product descriptions in the online store apply.


(6) The customer is solely responsible for informing themselves with how the purchased products work and their intended uses. In case of uncertainty, it is recommended to seek expert advice.

§ 4 Prices, Shipping Costs and Delivery

(1) The prices listed in the respective offers, as well as the shipping costs, are total prices and include all price components, including all applicable taxes.

(2) The respective purchase price must be paid in advance of the product’s delivery (prepayment), unless we expressly offer purchase on account. The payment methods available to you are listed under a corresponding button in the online store or in the respective offer. Unless otherwise specified for the individual payment methods, payment is due immediately. Currently, the available payment methods include Shop Pay, Apple Pay, Google Pay, Klarna, PayPal, credit card, and EPS transfer. 

(3) Coinfinity is entitled to withdraw from this contract without further justification should the buyer fail to meet their payment obligation within two weeks. Any partial payments already made by that time will be refunded to the buyer.

(4) In addition to the listed prices, shipping costs apply for the delivery of products, unless the respective item is marked as free shipping. The shipping costs will be clearly communicated to you again in the offers, in the shopping cart system if applicable, and in the order summary.

(5) We currently offer shipping within Austria and to all other countries listed in the shipping options. Items can also be picked up in person at our store in Vienna during regular business hours. 

§ 5 Right of retention

The goods remain our property until the purchase price has been paid in full.

 

§ 6 Right of Cancellation

(1) As a consumer, you have the right to cancel this contract.

You have the right to cancel this contract within fourteen days without giving any reason.


The withdrawal period is fourteen days from the day,

  • on which you or a third party designated by you, other than the carrier, took possession of the goods, provided that you ordered one or more items as part of a single order and they are delivered together, or

  • on which you or a third party designated by you, who is not the carrier, took possession of the last item, provided that you ordered multiple items as part of a single order and they are delivered separately, or

  • on which you or a third party designated by you, who is not the carrier, took possession of the last partial shipment or the last item, provided that you have ordered goods that are delivered in multiple partial shipments or pieces, or

  • on the date on which you or a third party designated by you, who is not the carrier, took possession of the first item, provided that you have entered into a contract for the regular delivery of goods over a specified period of time.

To exercise your right of withdrawal, you must inform us (Coinfinity GmbH, Griesgasse 10, 8020 Graz, Austria, phone number: +43 316/711 744, email address: support@coinfinity.co) by means of a clear statement (e.g., a letter sent by mail, email) regarding your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

(2) If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires. You are responsible for the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to check their condition, properties, and functionality.

§ 7 Data Protection

(1) Coinfinity places particular importance on protecting the privacy and data of its customers. Coinfinity complies with all provisions of the General Data Protection Regulation (“GDPR”) as amended from time to time.

(2) Please note that, in the course of its business activities, Coinfinity collects, stores, and processes the following personal data from customers (hereinafter “personal data”): first and last name, residential address, shipping address, citizenship, date of birth, email address, phone number, bank account details, and IP address.

(3) This data processing is necessary, on the one hand, for the performance of the contract and, on the other hand, for compliance with legal requirements to which Coinfinity is subject. Furthermore, the processing of personal data is necessary to safeguard the legitimate interests of Coinfinity. Coinfinity thus acts lawfully within the meaning of the GDPR (Art. 6 GDPR). 

(4) Coinfinity stores personal data only for as long as Coinfinity deems necessary to achieve the stated purposes and as permitted by applicable law. In any case, Coinfinity will retain the personal data for as long as statutory retention obligations exist or any legal claims have not yet expired.

§ 8 Liability

(1) Coinfinity shall not be liable unless damage was caused intentionally or through gross negligence by Coinfinity or a third party for whom Coinfinity is responsible. This does not apply to injury to a person’s life or health. Coinfinity’s liability, with the exception of data loss that Coinfinity could not have prevented under any circumstances, is excluded to the extent permitted by law. This applies, for example, to damages caused by force majeure, unforeseeable events, in particular network disruptions, computer failures, or criminal activities by third parties. The exclusion of liability does not apply if Coinfinity caused the damage through negligence. Coinfinity is therefore liable for damages caused by negligence on its part.

(2) Coinfinity is committed to ensuring the smooth and continuous operation of the website. Some of the information on the Coinfinity website is provided by third parties. Although Coinfinity carefully reviews the data provided, due to technical constraints and in the case of data generated outside of Coinfinity’s control, it cannot guarantee or warrant that the services offered on the website will meet customer requirements or be uninterrupted, timely, secure, or error-free.

(3) Coinfinity reserves the right to restrict access to the website, in whole or in part, temporarily or permanently, due to maintenance work, capacity issues, or other events beyond its control. Coinfinity is committed, where possible, to schedule maintenance work or changes to the server at least two days in advance if it is expected that the maintenance or change will result in an interruption of the availability of the services offered or if advance notice appears necessary for other reasons. The customer must regularly check the website for information regarding planned maintenance work; there, the customer will find information regarding the scheduled times for maintenance work. Outages during necessary maintenance or repair work, as well as outages during the agreed-upon maintenance windows, do not give rise to any claims by the customer against Coinfinity, unless Coinfinity has acted with intent or gross negligence. This does not apply in cases of injury to a person’s life or health. Coinfinity therefore assumes no liability for technical malfunctions of the website or for maintenance work if, as a result, the customer is unable to purchase products via the Coinfinity website at that time.


 

§ 9 Warranty, Customer Service

(1) The warranty is governed by statutory regulations.

(2) For businesses, the warranty period for delivered goods is 12 months.

(3) As a consumer, you are requested to inspect the goods or services provided immediately upon delivery for completeness, obvious defects, and shipping damage, and to notify us of any complaints as soon as possible. Failure to do so will, of course, have no effect on your statutory warranty claims.

(4) Our customer service is available on weekdays via email at shop@bitcoin.wien to answer questions and handle complaints and claims.

§ 10 Contract Language

§ 11 Final clauses

(1) These Terms and Conditions are governed by Austrian law, excluding the conflict-of-laws rules of private international law. For disputes arising from or in connection with these Terms and Conditions or a contract concluded with Coinfinity based on these Terms and Conditions, the relevant court in Graz shall have exclusive jurisdiction; in the case of contracts with consumers, the court of the consumer’s place of residence shall have exclusive jurisdiction (principle of favorability).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

(3) If the customer is a business, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider’s registered office.

(4) Severability clause: If one or more clauses of this contract are or become invalid, or if one or more clauses of this contract are omitted for any reason, or if the contract contains a gap, a valid clause shall be agreed upon that best reflects the purpose of this contract or best fills the gap that has arisen or been identified, taking into account the interests of both contracting parties as expressed in this contract. Dispositive law shall only apply if, taking into account the remaining clauses of this Agreement and the purpose pursued by the contracting parties, no other clause appears more appropriate.
